Lastly, the patent attorney candidates must possess a “good moral character as well as a firm reputation.”

An important step in the patent process is the necessary patent search. During this phase of the licensing an involved check is accomplished on your patent to ensure that there are no prior patents issued that are similar or duplicated of your invention. So important is this step that it must usually be completed before any additional work can be accomplished on the patent. You must ensure that you are the first to have the idea or you will waste a considerable amount of money trying to obtain a patent.

You can always perform the search yourself or obtain the services of a New York Patent Lawyer to do it for you. There are 2 types of searches which you can do. The first type is a paperwork kind of search. Usually this is conducted within the confines of the patent office’s search room. The second search is by use of the internet to search for an invention.

Next you will need to write your application up for your patent and then properly file it. Oh yes at this point in time we can not forget to pay the necessary filing fee which will be due the Patent Office. After your patent application is received at the Patent Office it will be assigned to an examiner to evaluate it. At this time he will conduct his own search and within 36 months you will receive his review papers. These papers will accept, object to or reject your patent. If they are accepted then a patent will be issued.

Obtaining a patent can be a time consuming task however in the interest of your invention it is well worth it.
